The terms for using Hubly.
These terms describe the agreement between you and Zeniva Digital when you create a Hubly workspace, publish a business page, or manage a client profile.
01 / Acceptance
By accessing or using Hubly (the “Service”), operated by Zeniva Digital, you agree to these Terms of Service. If you do not agree, do not use the Service.
02 / The service
Hubly provides customer-facing business pages, campaign links and QR codes, traffic attribution, audience signup records, promotional flyers, custom-domain routing, confirmed conversion reporting, and agency workspaces. Product capabilities may change as the Service develops.
03 / Your account
- Keep your account credentials secure and provide accurate information.
- You are responsible for content published through your workspace.
- You must be at least 16 years old to use the Service.
- Notify us promptly if you believe your account has been compromised.
04 / Acceptable use
- Do not violate applicable law or another person’s rights.
- Do not distribute malware, spam, phishing, or deceptive links.
- Do not impersonate another person or business.
- Do not attempt unauthorized access or interfere with the Service.
- Do not use attribution or conversion features to collect prohibited sensitive data.
- Do not use audience features for purchased, scraped, deceptive, or unlawfully obtained addresses.
05 / Your content
You retain ownership of content you upload. You grant Hubly a non-exclusive license to host, display, and process that content only as needed to operate the Service. Removing content ends that license except where limited retention is required for security, legal, or backup purposes.
06 / Agencies and clients
Agency users must have authorization before creating or managing a client profile. Clients may disconnect access. Agency owners are responsible for the actions of members they invite to their organization.
07 / Audience and consent
A business using audience capture is the sender responsible for its mailing purpose, identity, contact information, messages, and legal basis. It must present accurate consent language, honor withdrawals and suppression records promptly, and follow applicable anti-spam, privacy, and consumer-protection laws.
Hubly records the signup evidence available to the Service, but does not guarantee that a particular consent is sufficient for every message, recipient, or jurisdiction. Exporting a list does not authorize a new purpose or remove the business's obligations.
08 / Custom domains
You may connect only a domain you are authorized to control. You are responsible for accurate DNS configuration and content served on that domain. Hubly may pause or remove a domain that fails verification, creates security or abuse risk, infringes rights, or no longer points to the Service.
09 / Availability
We work to keep Hubly available and accurate, but do not guarantee uninterrupted service or that every third-party integration will remain available. We may modify or discontinue features with reasonable notice when practical.
10 / Termination
You may stop using Hubly or request account deletion at any time. We may suspend or terminate accounts that violate these terms, create risk for other users, or threaten the integrity of the Service.
11 / Liability
The Service is provided “as is” to the extent permitted by law. Zeniva Digital is not liable for indirect, incidental, or consequential damages arising from use of the Service.
12 / Changes and contact
Continued use after an effective-date change means you accept the updated terms. We will provide notice of material changes.
